Fine of up to Rs 10 lakh for false complaint to Lokayukta
The Chief Minister, Mr Manohar Parrikar on Monday introduced the Goa Lokayukta (First Amendment) Bill, 2013 in the assembly. The Bill will come for discussion in the legislative assembly on January 31. The House also adopted the Goa Lokayukta Rules 2012.
The amendment to Section 19 of the Goa Lokayukta Act 2011 is about penalty, including fine to be paid in case someone files a false or frivolous complaint with the Lokayukta. The amendment replaces ‘not more than rupees ten thousand’ provision with ‘which shall not be less than rupees one lakh and which may extend to rupees ten lakh’.
The amendment also inserts new section, Section 19A in the Act titled Offence and Penalty. It notes that the penalty can be imposed if the complaint to Lokayukta is found to be a complaint containing false allegations, a complaint with malafide intention or ulterior motive, a complaint with intention to malign or tarnish the image or reputation of the public functionary, a complaint with an affidavit containing false statements, or a frivolous or vexatious complaint.
