Goa govt not to press contempt plea against Karnataka

Panjim: In the wake of an affidavit filed by the Karnataka government before the Mahadayi River Water Dispute Tribunal, giving an undertaking that nothing would be done to divert water of River Mhadei till the tribunal takes a decision in the on-going case, Goa government decided not to press its contempt petition filed before the tribunal.Advocate General Dattaprasad Lawande confirmed that Goa will not go ahead with its Interlocutory Application (IA) filed before MWDT after Karnataka illegally diverted water through the canal. “In view of the reply filed by Karnataka last week we decided not to press for contempt at MWDT but take it up at an appropriate forum,” Lawande told Herald. He said the State cannot take up the petition in MWDT.
In its reply, Karnataka submitted that the IA is not maintainable by law. “None of the orders of the tribunal dated 16/10/12, 19/03/13, 21/08/13, 17/04/2014 and 27/07/2016 have been notified and made effective under Sec 6(1) of the Inter-State River Water Disputes Act 1956. Therefore no application can be moved based on alleged violations of the said orders,” the reply had stated.Karnataka also questioned the powers of the Tribunal on such IA stating, “Considering the orders are enforceable, the tribunal has no jurisdiction to initiate proceedings against any official as it is neither a court having powers to punish nor any powers are conferred on tribunal.”On the allegations that Karnataka has changed the nature of flow of water it said it is “ridiculous and baseless”.
