Poll petition against Caitu: documents submitted in HC


Documents to prove her case were submitted, on Thursday,  in the High Court of Bombay in Goa in the election petition filed on July 16 by Valanka Alemao against Goa Vikas Party’s Caitan ‘Caitu’ Silva.
The petition challenged his election under Section 16 of the Representation of People’s Act 1950.
Arguments were also heard.  The next hearing has been kept for the first week of January. Ms Alemao had lost the Benaulim election against Caitu earlier this year. The petition has alleged that Silva is a Portuguese citizen. As per Article 173 (a) of the Constitution of India, only an Indian national is qualified to be a MLA.
According to the petition, Silva’s registration of his birth at the Lisbon  Conservatória dos Registos Centrais on July 21, 2010 meant that he was no longer an Indian national and “in terms of law of that country amounts to acquisition of  Portuguese citizenship.”
Among the attachments is a note from the Indian Consular Attaché in Lisbon to the Union External Affairs Ministry that says that Caetano Rosario Silva was registered as Portuguese national on July 21, 2010 as per documents and confirmation by the foreign office.
Ms Alemao also produced a letter dated April 2, 2012 from K A P Sinha, IAS, private secretary to Union Minister of State for External Affairs, stating that the Indian Embassy in Lisbon had confirmed that Caetano Rosario Silva is registered as Portuguese national since July 21, 2010. [NT]
