‘Register FIR against garage owner’

 

Special Judge, Anuja Prabhudessai directed the SP vigilance to register FIR against one O C da Costa, garage owner implicated in a vigilance investigation and accused of giving false certificates, to transport department officials, and investigate the crime as “well as the involvement of any other person in the said crime.” The FIR is to be registered under various sections of the IPC and the Prevention of Corruption Act. 
The order was issued in a case filed against Transport Director Arun Desai, Assistant Director of Transport, Prahlad Dessai, Transport Minister Ramkrishna Sudhin Dhavalikar, KTCL Chairman, Deepak Dhavalikar, Milind Bhobe and Oden Champ Da Costa, Assistant Motor Vehicle Inspector.
The order comes after the complainants sought probe against the “aforesaid persons who are arrayed as accused” on grounds of illegally filling 29 posts of assistant motor vehicle inspectors when only 14 posts were advertised.
Alleging that that such acts are in contravention of the decisions of the apex court and of the High Court, the complainants also alleged that that about 18 applicants had given bogus and forged certificates and these were not verified by the accused number one with the connivance of accused number two and in criminal conspiracy with accused number three, four and five due to illegal gratification received by them after repeated “oral requests from the complainant.”
The order says that the complainants also said that the accused had permitted the applicants to insert permanent license and other certificates after the last date of accepting the forms.
Though the judge, in her order said that the allegations made by the complainants are too vague and bizarre to order an investigation, it notes that there is a written complaint by one Yasser Ismail, and records indicate that an inquiry was conducted and registrations of FIR was recommended against accused number six, garage owners, Transport Department officials under various sections of the IPC and the Prevention of corruption Act.
However the case was not registered after a complaint was filed, so registration was kept on hold. [H]
